Current situation

The 713th Contracting Squadron (713 CONS) is conducting an organized preproposal site visit for the $38.40 million Cargo Pier Fender and Corrosion Repairs task order under SM-MACC-01. Representatives of SM-MACC-01 holders attend. During the walkthrough, you notice a Diamond Dogs Civil Works, LLC representative has pulled SSgt Olga Gurlukovich of the Logistics Readiness Squadron (713 LRS) aside for a private conversation near the east cargo apron.

When you ask what they discussed, SSgt Gurlukovich explains that Diamond Dogs asked when the east cargo apron would be available for crane staging, material laydown, and contractor equipment. She says she merely told the representative that the apron will be unavailable from 14 through 25 June 2027 for the summer sealift but available on the other contemplated staging days, subject to ordinary daily Port Operations controls. That schedule does not appear in the task-order solicitation.

Release as a short standalone inject at Increment 6. SSgt Gurlukovich's schedule is accurate; the defect is the unequal Government disclosure after solicitation release. The schedule affects means and methods, crane reservations, sequencing, price, and the technical approach. FAR 15.201(f) makes the Contracting Officer the focal point and requires material proposal-preparation information disclosed to one competitor to be made broadly available. FAR 16.505 supplies the MACC fair-opportunity rule.

The strong response is to immediately provide the same schedule through the common task-order channel to every SM-MACC-01 holder while proposals can still account for it. Release N-04 only if trainees ask for the exact schedule or its accuracy. N-02 and M-03 already identify the complete MACC pool, so no separate distribution-list handout is needed. No draft notice is needed and trainees do not prepare one.

If trainees leave the exchange alone, Diamond Dogs later wins. A disappointed holder's postaward FOIA request reveals the private disclosure, and Diamond Dogs' technical approach aligns precisely with the unpublicized schedule. The holder files a timely GAO protest alleging a prejudicial breach of fair opportunity. The $38.40 million value places the modeled DoD order above the task-order protest threshold; the Government takes corrective action and reopens the competition, delaying the pier work and incurring protest and reevaluation effort. After trainees discuss the private exchange, ask: ‘How do fair-competition concerns affect Government exchanges with one or more contractors, and what regulation states the relevant proposal-information principle?’ This is fishing for FAR 15.201(f). If needed, direct them to that paragraph, then have them connect it to the MACC fair-opportunity procedures in FAR 16.505.

After some further discussion, ask: ‘Can the fairness problem be cured by telling the rest of the site-visit attendees, so everyone there has the same information?’ If the team says yes, have it compare N-02 with M-03. Equalizing only the attendees still excludes eligible SM-MACC-01 holders that did not attend and therefore does not cure the fair-opportunity problem.

What a strong analysis should surface

  1. FAR 52.236-27 encourages offerors to inspect the construction site; it does not turn an organized visit into a separate channel for unverified interpretations or material proposal assumptions.
  2. The pier order exceeds $7.5 million. FAR 16.505(b)(1)(iv) requires fair notice of a clear requirement and a fair opportunity for all eligible MACC holders; material staging information should reach the whole pool through the common ordering channel.
  3. FAR 15.201(f) supplies a useful proposal-preparation principle: after solicitation release the Contracting Officer is the focal point, and specific acquisition information necessary to prepare proposals should be made broadly available rather than giving selected firms an advantage. Apply that principle consistently with the MACC's FAR 16.505 procedures.
  4. The problem is not that every onsite conversation is forbidden. It is that a Government representative already gave one competitor accurate, nonpublic dates that materially affect staging, crane reservations, schedule, and price. The cure is immediate common disclosure before proposals are due.
  5. The $38.40 million modeled order is above the applicable DoD task-order protest jurisdiction threshold. If the Government leaves the unequal disclosure uncorrected, Diamond Dogs' schedule-perfect technical approach supplies a concrete prejudice theory rather than mere speculation.
