Trainees determine whether workers were paid the wage determination's minimum for the classification of work actually performed, not merely the classification written on a certified payroll.

Current situation

On 13 September, the Campbell Hall COR sends a factual concern after observing four Volgin Electrical Services, LLC employees installing conduit and raceway, pulling conductors, mounting electrical equipment, and making de-energized terminations. Volgin is Peace Walker Infrastructure Partners, LLC's disclosed electrical subcontractor, but its current certified payroll reports all four as Laborer - Common or General.

Peace Walker transmitted the payroll and says each employee received the reported basic wage and fringe contribution. The incorporated wage determination contains both Electrician and Laborer rates. Payment Request No. 005 was resolved on 1 September, while the task order remains active and its next regular payment cycle follows the 20 September cutoff. Determine what the initial record establishes, what additional compliance checks are warranted, and what amount—if any—must be protected from the next available payment.

Release K-01 through K-03 at Increment 19 on 13 September, after [D] and regardless of its outcome. Do not reuse D-01 as a pending request: Payment Request No. 005 was resolved on 1 September. This event tests whether a certified payroll is checked against the classification of work actually performed and whether a supported labor withholding is distinguished from the earlier earned-progress decision.

After the initial discussion, use the Trainer Addition. Release K-04 for duration, K-05 for field corroboration, K-06 for worker interviews, K-07 for local area practice, and K-08 for the contractor's explanation. FAR 22.406-6 and FAR 22.406-7 identify payroll examination, onsite inspection, interviews, and comparison with inspector reports or daily logs as normal compliance tools. K-07 keeps the exercise at walk level by resolving the local classification question rather than expecting trainees to know a trade boundary from intuition.

The exercise wage determination sets Laborer at $31.20 basic plus $15.60 fringe and Electrician at $53.40 basic plus $23.10 fringe. The evidence establishes four workers, 120 affected hours each, and a $29.70 hourly difference, producing a $14,256 estimated underpayment. No overtime, split-classification time, conformance, or registered-apprentice issue is included.

Offer only the two listed dispositions. The intended response is to act through Peace Walker as prime, require corrected payrolls and $14,256 restitution, and protect that amount through withholding from the next available payment under FAR 22.406-9 and FAR 52.222-7 while the violation remains unresolved. Adjust or release the withholding after restitution and reconciliation. Preserve evidence and refer suspected knowing falsification through appropriate channels without declaring fraud proven. If trainees suggest stopping every dollar or only correcting future payrolls, say: 'That could fit broader or future noncompliance, but what must happen to these four workers and the supported $14,256 deficiency?'

What a strong analysis should surface

  1. 40 U.S.C. § 3142 and FAR 52.222-6 require at least the wage determination's basic rate and fringe benefits for the classification of work actually performed. Calling electricians general laborers on a certified payroll does not change the work.
  2. The supported restitution is $14,256: four workers × 120 hours × ($76.50 electrician total − $46.80 laborer total).
  3. FAR 22.406-6 and FAR 22.406-7 support the evidence sequence: examine payroll classifications, rates, fringes, hours, and deductions; interview employees; inspect onsite work; and compare payrolls with inspector reports and daily logs.
  4. Administer the issue through Peace Walker as the prime under FAR 52.222-8. If trainees suggest reopening Payment Request No. 005, stopping every payment, or making only a prospective correction, say: 'That may fit different facts, but [D] is closed. What will you do about these four workers and the supported $14,256 deficiency on the active order?'

Certification does not make the classification conclusive. FAR 52.222-6 ties the required rate to the work actually performed, and FAR 22.406-6 and FAR 22.406-7 direct the Government to test payroll data against field evidence and interviews. The later compliance review establishes that all 480 hours were Electrician work and validates a $14,256 deficiency.
